Something like that should be considered a safety/driveability issue and you shouldn't have to worry about a warranty, especially if there have been a lot of problems with it. Had a g.f. in Illinois with a focus zx3 kept popping the back hatch, she was the second owner and there was no warranty but the dealer had to replace all the mechs in the latch because it was a serious problem with all the hatchback focus'. My T'bird (92) had a problem with the rear struts leaking from the factory and even though it was 14 yrs old and had 200000 miles on it since it was factory suspension the local dealer (again in illinois) replaced them free of charge, all because there were service bulletins stating that both problems had been wide-spread.

That's the problem, is I don't think there are any service bulletens yet.

Even if there are service bulletins, they often only apply with a warranty intact. That was the case with the brakes on our CX-9...
